Abstract
ABSTRAK Konflik sengketa tanah di Gereja Toraja Jemaat Penanda di Kelurahan Buangin, Kabupaten Toraja Utara, menggambarkan kompleksitas permasalahan hukum, adat, dan sosial dalam penentuan kepemilikan tanah. Konflik dimulai dari klaim kembali atas tanah yang semula dipersembahkan oleh Tongkonan untuk gereja pada tahun 1918. Tanah ini menjadi sengketa ketika keturunan pendiri, setelah puluhan tahun meninggalkan lokasi gereja, mengklaim kembali tanah berdasarkan warisan keluarga. Tanpa sertifikat resmi, status kepemilikan tanah menjadi tidak jelas menurut hukum modern, memicu proses hukum panjang dan memakan biaya. Melalui teori konflik Ralf Dahrendorf, analisis ini menyoroti pelanggaran terhadap perjanjian adat, egoisme pribadi, ketidakjelasan legalitas, dan dimensi kekuasaan yang menjadi faktor pemicu konflik. Penyelesaiannya melalui negosiasi, arbitrase, mediasi, dan akhirnya peradilan menunjukkan pentingnya memiliki dokumen hukum yang jelas untuk melindungi aset gereja dan memulihkan kedamaian di antara komunitas. Refleksi teologis menunjukkan pentingnya perdamaian dan pengampunan dalam menangani konflik, seiring dengan upaya mencapai keadilan yang sesuai dengan prinsip kehidupan beragama. Pelajaran dari kasus ini menggarisbawahi pentingnya mengurus surat sertifikat tanah untuk melindungi aset gereja dari klaim di masa depan, menegaskan perlunya investasi dalam perlindungan hukum untuk keberlanjutan gereja dan jemaat. Kata Kunci: Konflik, Gereja ABSTRACT The land dispute conflict at the Toraja Church of Jemaat Penanda in Buangin Village, North Toraja District, illustrates the complexity of legal, customary, and social issues surrounding land ownership determination. The conflict originated from the reclaiming of land originally dedicated by the Tongkonan for the church in 1918. This land became disputed when descendants of the founders, after decades of leaving the church location, asserted ownership based on family inheritance. Without an official certificate, the legal status of land ownership became unclear under modern law, triggering a lengthy and costly legal process.Through Ralf Dahrendorf's conflict theory, this analysis highlights violations of customary agreements, personal egotism, legal ambiguity, and power dynamics as triggering factors in the conflict. Resolution involved negotiations, arbitration, mediation, and ultimately litigation, underscoring the importance of clear legal documentation to protect church assets and restore peace within the community. The theological reflection underscores the importance of peace and forgiveness in conflict resolution, alongside efforts to achieve justice aligned with religious principles.This case underscores the importance of managing land certificates to protect church assets from future claims, emphasizing the need for investment in legal protection for the sustainability of the church and congregation
